Security of payment

We have created a Member Guide that explains what will happen when WA's new Security of Payment laws and regulations are introduced.

WA's Building and Construction Industry (Security of Payment) Act 2021 is designed to protect payments to subcontractors. The Act and the supporting regulations are being introduced in three stages commencing from 1 August 22.

The changes include

  • the right for a head contractor to claim payment within 20 days and a subcontractor within 25 days
  • an adjudication process for resolving disputes
  • fairer contracting practices
  • a trust scheme to protect retention money
  • new powers to discipline building contractors

While these changes are designed to protect subcontractors, there are some consequences that may not be immediately obvious and which may create unforeseen risks.

Member Guide

The Member Guide is a new resource for members of The Master Plumbers and Gasfitters Association of WA. It provides an outline of what will happen in each stage of implementation, the adjudication process and the business implications of the new laws.

Association members may obtain it by logging into the members-only area and selecting 'Security of Payment Law' under Members' resources (on the left-hand side of the page).

As well as answering your question individually, we will compile a list of all the questions that members ask. We will use it to produce an FAQ that we will publish in the members-only area of the website.
